I have today (23/11/2006) returned from PCWorld Teesside Park store having being ejected by the police for trespass.

 

On 30/08/2006 I purchased a Tomtom one which failed completely 2 months and 2 days old. I returned it to the above store

where it was checked and found to be faulty. I was advised they would not offer a refund or replacement but would send it

off to Tomtom. I expressed concern and unhappiness at this offer but they were insistent and I left it with them. They

suggested I might wish to send the device to Tomtom myself but I felt my contract to buy was with them and they should

sort it out.

 

Two weeks later I returned to the shop to ask if the Tomtom one had been repaired or were they prepared to give me a

refund. I was advised that it was a week to ten days before Tomtom would have picked it up and no, they would not offer

a refund. They say I was informed that it would take a week to ten days before it was picked up but I deny this – if I was

aware of that fact then surely I would have sent it myself?

 

I pointed out that the sale of goods act states:

 

‘Any remedy must also be completed without significant inconvenience to the consumer’

 

I thought 2 weeks to affect a repair on an item 2 months old was reasonable. The manageress said no it was not, I

asked her what was reasonable and she replied “whatever I say is reasonable” I say so what might I take as

‘reasonable time’” she “I don’t know, depends on Tomtom”, (apparently she was too busy to call Tomtom)

me “so you hold all the balls then and I am not to know what is reasonable?” she “yes”

 

Several exchanges along the lines of she was unable to do anything and me saying but you are the manager

and generally circular arguments getting nowhere.

 

I am now angry and admit to raising my voice a little but did not swear and quickly calmed down. I did say I was

not leaving without a refund and would tell people what crap after sales service PCWorld gave.

 

She asked me to leave, I said not without a refund so she asked a security guard to escort me out, I refused

and the police were called and I went.
